Third Party vs. First Party chemical drift

Aug 15, 2024

VT Insurance Agency, a leading national insurance agency, provides comprehensive coverage for all aerial application operations. Whether you’re spraying your own fields or are a custom aerial application professional, we can help you navigate the complex world of drone insurance.

Understanding the Difference: Third-Party vs. First-Party Chemical Drift

Chemical drift occurs when pesticides or other chemicals unintentionally spread beyond their intended target area, potentially damaging neighboring crops, property, or other people. Both third-party and first-party chemical liability coverage can provide coverage for chemical drift, but it’s important to understand the difference between the two.

Third-party chemical liability insurance is going to be standard for any aerial application policy and is a required coverage in most states. It protects you against claims from others who have suffered damages due to your negligence. In the case of chemical drift, this could include damage to crops, property, or personal injury.

First-party chemical liability is typically in the form of a “Crops Treated” or “Adjacent Fields” endorsement. This coverage only applies to commercial operations and is there in case you have a contaminated hopper or a miss mixing of chemical where you damage or destroy the field you’re intending to spray. This will include damage to the crops you’re being paid to spray. Not all companies will offer first party chemical liability so it is important to know if you’re fully covered in all cases. This is especially important if you are spraying herbicides or defoliants. Our experienced team of aerial application insurance agents will make sure you’re properly covered for your needs!
